Texas HB 2127

Texas HB 2127 is a 2023 state law that overrides certain local rules. It ended the Austin and Dallas ordinances that required water breaks for construction workers.

Texas HB 2127 is a state law passed in 2023. The Texas Legislature lists it as effective September 1, 2023. Supporters called it a way to end a patchwork of local rules. It named local minimum workplace break rules as one target. That ended the water-break ordinances Austin passed in 2010 and Dallas passed in 2015.

The law did not end heat hazards at work. OSHA still enforces them under the General Duty Clause and the Heat National Emphasis Program. Employers still need a plan for water, rest and shade. See Texas heat rules for employers for the current picture. This page is not legal advice.
